Purchasing Property

If you are considering the purchase of a home in a particular state of Australia then you should immediately consult with a legal specialist, before you sign any form of documentation. Our solicitors will ensure that the Contract of Sale is reviewed before you sign on the dotted line. It is quite common for a purchaser to be pressured to sign documentation/contracts whilst with the selling real estate agent. It is important that you seek legal advice prior to being locked into a binding contract.

Our solicitors will ensure that the necessary reports (for eg. Pest & Building Report) & searches are obtained prior to the purchaser becoming locked into a binding contract of sale. Following exchange we will ensure your mortgage (if applicable) has been correctly executed & your mortgagee has been provided with all the necessary documentation in order to settle the transaction.

Selling Property

We can assist you with the sale of your property. Once we have received your instructions to proceed, we will obtain all the necessary information & documents required to prepare the Contract of Sale. This document will be provided to the appointed selling agent in order for the property to be advertised for sale,

Please note:  A real estate agent must not advertise a property without a "Contract of Sale".

Once you have found a buyer for your property, we will arrange the exchange of contracts with the buyers legal representative. We will ensure all amendments to the contract are negotiated & agreed upon by all parties prior to an exchange.

If applicable, we will arrange for your Mortgage on title, to be discharged on settlement of the transaction.

Given the recent changes in conveyancing procedures, with the introduction of electronic conveyancing, the legal process can be quite daunting. We therefore recommend the appointment of a solicitor to help you through the sale transaction.

Refinancing your property

POWERS OF ATTORNEY

Our firm can assist you with the drafting and lodgment of a Power of Attorney. A Power of Attorney is a legal document where you nominate a person or trustee organisation to manage your assets and financial matters, in case you're unable to do so. For eg. you may be travelling, or ill, or have had an accident. You still have control of your affairs and you can revoke your Power of Attorney at any time, provided you have capacity to understand and appreciate the significance of the decisions you are making.

A General Power of Attorney becomes invalid when you die, or you lose the mental capacity to manage your own affairs.

An Enduring Power of Attorney however will continue to have effect during your lifetime, even if you lose the capactity to self manage your affairs. It also becomes invalid on your death.

We will assist with the drafting of the legal documents and lodge them for registration on your behalf at the Land and Property Information Department.

YOUR LAST WILL & TESTAMENT

Now you have settled your property transactions, you may wish to have your Last Will and Testament drafted by our firm.

A Will is a legal document with instructions for who you want to inherit your estate. A Will helps you to communicate your final wishes to your friends and family about how to distribute your property, pay off your debts, handle business or family needs.

If you pass away without creating a valid Will, your estate is divided based on intestacy laws and your property may not be given to the beneficiaries you would have chosen.

We can assist with the drafting of the entire document, arrange for the Will to be signed and witnessed by 2 witnesses.
